Terms of Use

1. Purpose

These Terms of Use (hereinafter "Terms") define the terms and conditions of use of the services offered by MyCataLog (hereinafter "the Service"), as well as the rights and obligations of the parties in this context.

MyCataLog is an online platform that allows users to create, manage and organize collections of personal items (figurines, cards, vinyl records, books, etc.) with the ability to add photos, descriptions and detailed information for each item.

2. Acceptance of Terms

Access to and use of the Service are subject to acceptance of and compliance with these Terms. By creating an account or using the Service, you acknowledge that you have read, understood and accepted these Terms in their entirety without reservation.

If you do not accept these terms, you must immediately stop using the Service.

3. Access to the Service

The Service is accessible free of charge to any user with Internet access. All costs related to accessing the Service (computer equipment, Internet connection, etc.) are the sole responsibility of the user.

MyCataLog reserves the right, without notice or compensation, to temporarily or permanently close access to the Service for maintenance, updates or any other reason deemed necessary.

4. Registration and user account

4.1 Account creation

To access certain features of the Service, you must create an account by providing accurate, complete and up-to-date information. You are responsible for the accuracy of the information provided.

4.2 Account security

You are entirely responsible for the confidentiality of your login credentials and all activities carried out under your account. In case of unauthorized use of your account, you must immediately inform MyCataLog.

4.3 Age requirements

You must be at least 16 years old to create an account. If you are between 16 and 18 years old, you declare that you have obtained authorization from your parents or legal guardians.

5. Subscriptions and pricing

5.1 Subscription plans

MyCataLog offers several subscription plans:

  • Standard (Free) : Limited access to the number of collections and items, limited storage space. The Standard plan includes Excel/CSV item import, capped at 1000 rows per file. Excel export remains a Plus / Premium feature.
  • Plus : Extended access with more collections, items and storage space, access to community and messaging.
  • Premium : Unlimited access to all features, extended storage and priority support.
  • Extra storage : Optional monthly paid add-on available alongside any plan (free or paid), allowing 1 to 200 GB of additional storage.

Plan details and prices are available on the Subscriptions.

A 14-day free trial is offered to any new subscriber of the Plus monthly plan, limited to one use per user. Any prior or current paid subscription disqualifies the user from this trial.

5.2 Payment and renewal

Paid subscriptions are billed in euros, including all applicable taxes where relevant, according to the chosen period (monthly or yearly for main plans, monthly only for the storage add-on). Payment is processed by our provider Stripe Payments Europe, Limited (Ireland), PCI-DSS certified. No banking data is stored on MyCataLog servers.

Renewal is automatic at the end of each period, unless the user cancels. Cancellation takes effect at the end of the current paid period: the user retains access to their plan until that date, after which they are automatically switched to the free (Standard) plan.

The user can change their plan (upgrade or downgrade) at any time from the management area accessible via their profile. Plan changes may result in proration computed by our payment provider.

5.3 Subscription change or cancellation - Limit management

Important: In case of downgrading or cancelling a paid subscription to the free plan, the following rules apply:

  • Your data is kept : Your collections and items are never deleted when you switch to a lower plan or cancel a paid subscription down to the free plan. They are retained and remain accessible in read-only mode according to the rules below. You regain full access at any time by subscribing again to a higher plan.
  • Access to excess content : If the number of collections or items exceeds the limits of your new plan, excess items will be made read-only and inaccessible. The blocking order is determined by the creation date : the oldest collections and items remain accessible, while the most recent ones (created beyond the limit) will be blocked.
  • Example : If you had 6 collections with a Plus subscription and switch to Standard (limit of 2 collections), only your first 2 collections (by creation date) will remain accessible. The other 4 will be visible but not editable or viewable in detail until you subscribe to a higher plan.
  • Reactivation : At any time, you can subscribe again to a higher plan to regain full access to all your content.
  • Storage handling on downgrade : If your used storage exceeds the limit of your new plan (for example after cancelling the extra storage option or downgrading to a lower plan), the excess images (the most recent ones) will be replaced with a generic image until you free up space by deleting content or subscribe again to a higher plan. Profile pictures (avatars) and collection covers are not affected by this rule and remain always visible.

5.4 Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have a period of 14 days from each new subscription to exercise your right of withdrawal and obtain a full refund of your subscription, without having to justify any reason. This right does not apply to automatic subscription renewals.

To exercise this right, contact us via the contact form or by email at contact@my-cata-log.com specifying your withdrawal request.

However, in accordance with Article L221-28 of the French Consumer Code, if you expressly requested immediate execution of the service at the time of subscription and the service was fully performed before the end of the withdrawal period, the right of withdrawal can no longer be exercised.

The use of the 14-day free trial (article 5.1) does not affect this right of withdrawal: any paid subscription started after the trial benefits from the legal 14-day period starting from the first actual payment.

6. Notifications

The Service sends in-app notifications to inform the user of events concerning them. These notifications are part of the normal functioning of the Service and cannot be individually disabled.

Categories of notifications sent:

  • Social: accepted friend requests, reactions and comments on your posts.
  • Subscription: activation, end of trial, cancellation, payment failure, extra storage added.
  • Plan limits: thresholds reached on collections, items or storage.
  • System: maintenance, important updates, announcements from MyCataLog.
  • Newsletter: An in-app notification is created in addition to the email to inform you of new publications.

Read notifications are automatically deleted 90 days after being read. Unread notifications are kept indefinitely until the user acts on them.

7. Use of the Service

7.1 User behavior

The user agrees to:

  • Use the Service fairly and in accordance with its intended purpose
  • Not infringe the rights of third parties
  • Not distribute illegal, defamatory, obscene content or content that violates public order
  • Not attempt to compromise the proper functioning of the Service
  • Not use robots, scripts or other automated means to access the Service

7.2 User content

You retain all intellectual property rights to the content you publish (photos, descriptions, etc.). By publishing content, you grant MyCataLog a non-exclusive, worldwide, royalty-free license to display, store and distribute this content as part of the Service's operation.

You warrant that you have the necessary rights to all content you publish and that it does not violate any third-party rights.

The images you upload are stored as they are: the file we keep, and later return to you, is identical byte for byte to the one you sent. MyCataLog never re-encodes or resizes it. A temporary, reduced copy may be produced in memory solely for the check described below; it is never stored. In exchange, the space counted against your storage quota is the actual size of your files.

Before it is saved, every image is automatically analysed to detect content prohibited by article 7.1. An image flagged this way is refused and is not stored. If you believe an image was refused in error, write to us at the address given in the legal notice: your request will be reviewed by a person.

7.3 Visibility of public content and listing

Collections whose visibility you set to “public” are accessible to anyone holding their share link, and are listed in the Service's search tool (the “Explore” page), which is open to visitors without an account. Collections shared as “friends only” are never listed: their link remains a private sharing method.

Your username and avatar appear in search results only if you have published at least one public collection. You may opt out of listing at any time from your profile settings; your public collections then remain accessible to anyone holding their link.

Public profile pages and public collection pages are not indexed by external search engines.

8. Intellectual property

All elements constituting the Service (texts, graphics, software, images, videos, sounds, plans, names, logos, trademarks, creations and various protectable works, databases, etc.) as well as the site itself, are subject to French and international legislation on copyright and intellectual property.

These elements are the exclusive property of MyCataLog. Any reproduction, representation, modification, publication, transmission, distortion, in whole or in part, of the Service or its content, by any process whatsoever, and on any medium whatsoever, is prohibited without prior written authorization from MyCataLog.

9. Liability

9.1 MyCataLog's liability

MyCataLog undertakes to implement all necessary means to ensure the continuity and quality of the Service. However, MyCataLog cannot be held liable for:

  • Temporary interruptions of the Service for maintenance or updates
  • Malfunctions related to Internet infrastructure
  • Content published by users
  • Fraudulent use of the Service by third parties
  • Indirect damages resulting from use of the Service

9.2 User liability

The user is solely responsible for their use of the Service and the content they publish. They agree to indemnify MyCataLog for any damage resulting from a violation of these Terms.

10. Hyperlinks

The Service may contain links to third-party sites. MyCataLog has no control over these sites and disclaims any responsibility for their content or the practices of their operators regarding personal data protection.

11. Modification of Terms

MyCataLog reserves the right to modify these Terms at any time. Users will be informed of modifications by email or notification on the Service. Continued use of the Service after notification constitutes acceptance of the new Terms.

Any substantial modification of these Terms triggers an explicit acceptance request: on your next login, a modal window will display the new Terms and require your acceptance. Access to Service features requiring an account is suspended until you accept the new version. The date and version accepted are recorded in an audit log for traceability.

12. Termination

The user can terminate their account at any time from their profile settings. MyCataLog reserves the right to suspend or terminate access to the Service in case of violation of these Terms, without notice or compensation.

If you terminate your account at your request, your personal data (collections, items, images, notifications, community activity) is deleted immediately and permanently. Only your invoices (10 years, legal accounting obligation), the record of the consents given when subscribing (10 years) and an anonymized, non-reversible fingerprint of your email for fraud-prevention purposes are retained. The automatic deletion of accounts inactive for 3 years is subject to a separate archiving process (see GDPR §7).

When you delete your account, your customer identity with our payment provider (Stripe) is anonymized: your email, name and saved payment methods are removed from the corresponding Stripe profile. The profile itself is retained in anonymized form to comply with our accounting and tax obligations (10-year invoice retention, French Commercial Code article L.123-22). No further billing can be made on this profile.

13. Applicable law and jurisdiction

These Terms are governed by French law. In the event of a dispute relating to the interpretation or execution of these Terms, the parties agree to seek an amicable solution. Failing this, French courts shall have sole jurisdiction.

General Terms of Sale (CGV)

1. Purpose and scope

These General Terms of Sale ("CGV") govern the subscription of paid plans and paid options offered on the MyCataLog website (https://www.my-cata-log.com), published by Loris Planté (hereinafter "the Seller"). They apply to any subscription taken out by a consumer (hereinafter "the Customer"). Any subscription implies prior and unreserved acceptance of these CGV. The Terms of Use (CGU) otherwise govern the use of the service; in the event of a contradiction on a matter relating to the sale, the CGV prevail.

2. Seller identity

3. Services offered and prices

MyCataLog offers the following subscriptions:

  • PLUS: €5.99 per month or €59.99 per year;
  • PREMIUM: €12.99 per month or €129.99 per year;
  • Additional storage: monthly option from 1 to 200 GB, at €0.50 per GB per month, combinable with any plan (including the free one).

The details of each plan's features are presented on the Subscriptions page and in article 5 of the CGU. Prices are expressed in euros. VAT not applicable, article 293 B of the French General Tax Code.

The Seller reserves the right to change its prices at any time; the applicable price is the one in force on the day of subscription. Any price change to an ongoing subscription will be notified to the Customer at least 30 days before it takes effect. If the Customer refuses the new pricing conditions, they may cancel their subscription free of charge before they take effect; failing cancellation, the new price applies from the next renewal.

4. Free trial

A 14-day free trial is offered to any new subscriber of the monthly PLUS plan, limited to one use per user and provided they have never taken out a paid subscription. At the end of the trial, the subscription is automatically billed at the current price, unless cancelled before the end of the trial period. The trial end date is communicated to the Customer at the time of subscription.

5. Subscription, conclusion of the contract and payment

Subscription takes place online from the Subscriptions area of the Customer's account. Payment is due immediately and processed by Stripe Payments Europe, Limited (25/28 North Wall Quay, Dublin 1, Ireland), a PCI-DSS certified provider. No banking data is stored on MyCataLog's servers. The subscription is confirmed by email; the corresponding invoice is issued by the payment provider, sent to the Customer by email and made available in their subscription management area. The contract is deemed concluded as of this electronic confirmation of the subscription.

If a payment fails upon renewal, the Seller may have new payment attempts made in accordance with the payment provider's procedures. If the failure persists, access to paid features may be suspended after notification, the Customer then switching to the free plan under the conditions of article 5.3 of the CGU.

6. Performance of the service and consent to immediate performance

Access to the features of the subscribed plan is immediate upon payment confirmation. When subscribing, the Customer expressly requests, by means of a dedicated checkbox, that the performance of the service begin immediately, before the expiry of the withdrawal period, and acknowledges having been informed of the consequences of this request on their right of withdrawal under the conditions of article 8.

7. Duration, renewal and cancellation

Subscriptions are concluded for the chosen period (monthly or yearly; monthly only for additional storage) and automatically renewed by tacit renewal at each due date. The Customer may cancel at any time, free of charge and without cause, from the subscription management area accessible from their profile, in a few clicks. Cancellation takes effect at the end of the current already-paid period: the Customer retains access to their plan until that date, then switches to the free plan. The consequences of downgrading to a lower plan (data retention, excess content in read-only mode, excess images) are detailed in article 5.3 of the CGU. Plan changes during a period may give rise to proration calculated by the payment provider.

8. Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, the Customer has 14 days from the subscription of a new plan to withdraw, without cause. This right does not apply to automatic renewals of an ongoing subscription.

As the Customer has expressly requested immediate performance of the service (article 6), the exercise of the right of withdrawal is subject to the following regime:

  • in accordance with article L221-25 of the French Consumer Code, in the event of withdrawal, the Customer is refunded the amount paid, less an amount proportional to the service provided between the start of the subscription and the communication of their decision to withdraw;
  • in accordance with article L221-28 1° of the French Consumer Code, if the service has been fully performed before the end of the withdrawal period, the right of withdrawal can no longer be exercised.

To exercise this right, the Customer sends their request to contact@my-cata-log.com or via the contact form, unambiguously expressing their wish to withdraw; they may use the model form annexed hereto. The refund is made within a maximum of 14 days following receipt of the request, using the payment method used at the time of subscription.

Use of the free trial has no bearing: any paid subscription taken out at the end of the trial benefits from the 14-day period from the first effective payment.

9. Legal guarantees

The service provided is a digital service within the meaning of articles L224-25-1 et seq. of the French Consumer Code. The Customer benefits from the legal guarantee of conformity (articles L224-25-12 et seq.): the Seller is required to provide a service that conforms to its description and to remedy conformity defects free of charge. In the event of a defect, the Customer may demand that the service be brought into conformity or, failing that, a price reduction or termination of the contract under legal conditions.

10. Liability and force majeure

The Seller is bound by a best-efforts obligation regarding the availability of the service. Without prejudice to the legal guarantees referred to in article 9, it cannot be held liable for interruptions or malfunctions attributable to the Customer's Internet service provider, browsers, the Customer's equipment, or maintenance operations necessary for the proper functioning of the service.

The Seller cannot be held liable for delays or impossibility of performance due to force majeure within the meaning of article 1218 of the French Civil Code.

11. Invoices and contract archiving

Each payment, including renewals, gives rise to an invoice issued by the payment provider, sent to the Customer by email and viewable and downloadable at any time from the subscription management area. Invoices are drawn up in the language of the Customer's account at the time they are issued. Invoices are kept for 10 years in accordance with article L123-22 of the French Commercial Code, including after account deletion (see article 12 of the CGU).

In accordance with article L213-1 of the French Consumer Code, for any subscription of an amount equal to or greater than €120, the Seller archives the concluded contract (CGV in force, subscribed plan, date and confirmation of subscription) for a period of 10 years and guarantees the Customer access to it at any time upon simple request to contact@my-cata-log.com.

12. Personal data

The processing of personal data carried out in the context of the service and subscription management is described in the Privacy policy, accessible on this page.

13. Consumer mediation and disputes

In accordance with articles L612-1 et seq. of the French Consumer Code, the Customer may have free recourse to a consumer mediator in the event of a dispute not resolved after a written complaint to the Seller: [Consumer mediator: designation in progress]

Failing amicable resolution, the French courts have jurisdiction under ordinary law conditions.

14. Applicable law

These CGV are subject to French law. They may be modified at any time; the version applicable to a subscription is the one in force on the day of that subscription.

Privacy Policy and Data Protection (GDPR)

1. Data controller

The data controller is Loris Planté, contactable at contact@my-cata-log.com.

2. Data collected

We collect the following data:

  • Identification data: username, email address
  • Connection data: activity logs (action type, pseudonymous user identifier, called URL, HTTP method, response status, duration, browser type). Logs contain no email or username in plain text.
  • Usage data: collections created, items added, photos uploaded
  • Navigation data: pages visited, visit duration (via Google Analytics, with your consent)
  • Payment data: processed exclusively by our provider Stripe Payments Europe, Limited (Ireland), PCI-DSS certified. We only store on our servers a Stripe customer identifier and subscription metadata (status, expiration, plan). No banking data transits through MyCataLog.
  • Import flag: a boolean indicating an item was created via Excel/CSV import and has not yet received an image (to allow editing without an image requirement; it is cleared as soon as an image is added).
  • Visibility preferences: a flag indicating whether you agree to appear in the Service's internal search. It is enabled by default and can be disabled at any time from your profile.
  • Language preference: the language chosen for the interface, stored so that your emails and invoices are sent to you in that language. Can be changed at any time from the language selector.
  • Pre-contractual consent record: when you subscribe, we keep a record of your express request for immediate performance of the service and of your acknowledgement of its consequences on the right of withdrawal: user identifier, payment session identifier, timestamp, version of the terms in force, display language and type of subscription. No banking data is included.

3. Processing purposes

Your data is collected for the following purposes:

  • Creation and management of your user account
  • Provision and improvement of the Service
  • Subscription and billing management
  • Communication (notifications, newsletters if you have consented)
  • Statistical analysis and user experience improvement
  • Compliance with our legal obligations
  • Fraud prevention, Service security and audit logging (activity logs allow investigation of incidents and ensure traceability of sensitive actions, particularly administrative ones).
  • Connecting members and enabling discovery of the content you have chosen to make public (internal search, friend suggestions).
  • Automated moderation of uploaded images, to prevent the publication of content prohibited by the terms of use.

  • Contract execution: for managing your account and providing the Service
  • Consent: for sending newsletters and using Google Analytics
  • Legitimate interest: for security, moderation of uploaded content, Service improvement and the listing of public content in the internal search, which you may object to at any time from your profile
  • Legal obligation: for retention of billing data and of the record of your express request for immediate performance, required by article L221-25 of the French Consumer Code before any performance starting before the withdrawal period ends

5. Data recipients

Your data may be transmitted to the following recipients:

  • Hosts: Railway, AWS, MongoDB Atlas (secure storage)
  • Analytics service: Google Analytics (anonymized data, with your consent)
  • Email service: Brevo (Sendinblue SAS, France) - for transactional emails
  • Payment provider: Stripe (for payment processing)
  • Image moderation service: Amazon Rekognition (Amazon Web Services, Europe (Ireland) region) - automated analysis of images before they are stored.

We never sell your personal data to third parties.

6. Transfers outside the EU

Some of our providers (AWS, MongoDB, Railway) are located in the United States. These transfers are governed by the European Commission's Standard Contractual Clauses and/or the EU-US Data Privacy Framework, ensuring an adequate level of protection for your data.

7. Retention period

  • Account data: retained for the duration of your registration. After 3 years of inactivity, your account is deleted and anonymized; your collections and items are then archived for 3 additional years (legal obligation) before permanent deletion - i.e. a maximum retention of 6 years after your last activity
  • Billing data: retained for 10 years (legal obligation)
  • Connection logs: 1 year for activity logs (action, pseudonymous user identifier, URL, status, duration). No directly identifying personal data (email, username) is retained in logs.
  • Analytics cookies: 13 months maximum
  • In-app notifications: 90 days after reading for read notifications; indefinite retention for unread notifications until the user acts on them.
  • Trash (deleted items): items and collections you delete are moved to a trash and kept for 30 days (database and images), then permanently deleted. You can restore them or delete them permanently at any time during this period.
  • Pre-contractual consent record: kept for 10 years from the subscription date, including after your account is deleted, for the establishment, exercise or defence of legal claims (article 17.3.e GDPR) and in accordance with the obligation to archive contracts concluded electronically. This period matches that of billing data and departs from the one-year period applying to activity logs.
  • Images submitted for moderation: the analysis happens at upload time. MyCataLog keeps no separate copy of the image sent to the moderation service. That service does not reuse these images to train or improve its models, as MyCataLog has activated the opt-out provided for that purpose.

8. Your rights

In accordance with GDPR, you have the following rights:

  • Right of access: obtain a copy of your personal data
  • Right of rectification: correct inaccurate or incomplete data
  • Right to erasure: request deletion of your data
  • Right to restriction: limit the processing of your data
  • Right to portability: receive your data in a structured format
  • Right to object: object to the processing of your data
  • Right to withdraw consent: at any time, without affecting the lawfulness of prior processing

The right to erasure does not apply to the record of your pre-contractual consent: keeping it remains necessary for the establishment, exercise or defence of legal claims (article 17.3.e GDPR). It is limited to the data strictly necessary for that purpose and is deleted automatically after 10 years.

1. What is a cookie?

A cookie is a small text file placed on your device (computer, tablet, smartphone) when you visit our site. It stores information about your browsing.

2.1 Strictly necessary cookies

These cookies are essential for the site to function and cannot be disabled:

  • User session: maintaining your connection
  • Preferences: theme (light/dark), language
  • Security: protection against CSRF attacks
